Please read these terms before using the site. The following terms govern and apply to your use of the site maintained by OnFit Inc. (the "site").

By accessing or browsing the site, you declare that you have read and understood these terms of use and agree to be bound by them. Please note that we may modify the terms at any time and without notice. Your continued use of the site will be considered acceptance of the revised terms.

1. Intellectual property

All intellectual property on the site is owned by us or our licensors and includes any element protected by copyright, trademark or patent. All registered trademarks are owned, registered and/or licensed by us. All content on the site, including but not limited to text, software, code, design, graphics, photos, sounds, music, videos, applications and interactive features, is a collective work under Canadian law and is the property of OnFit Inc. All rights reserved.

2. Use of company content

We may provide you with certain information as a result of your use of the site (documents, data or information developed by us, or any other item that may assist you, the "Company Content"). The Company Content may not be used for any purpose other than using the site and the services offered. Nothing herein may be construed as granting you a license or intellectual property rights.

3. User account and account use

If your use of the site requires an account identifying you as a user (a "user account"):

• you are solely responsible for your account, its maintenance, confidentiality and security, all passwords related to it, and the activity of anyone who accesses it with or without your permission;
• you agree to immediately report any unauthorized use of your account or any breach of its security, and to assist us in remedying it;
• you agree to provide truthful, accurate and current user information, and to report any changes so the information we hold remains accurate.

4. Affiliate marketing and advertising

Through the site and its services, we may engage in affiliate marketing for which we receive a commission or a percentage of sales. We may also accept advertising or sponsorships from commercial businesses or receive other forms of advertising compensation.

5. Acceptable use of the site

You agree not to use the site for unlawful purposes or in any way that could harm the site, the services or the business of OnFit Inc. In particular, you agree not to use it to:

• harass, abuse or threaten others or otherwise violate a person's rights;
• violate the intellectual property of OnFit Inc. or any third party;
• upload or transmit viruses or any software that could damage the property of OnFit Inc. or others;
• commit fraud;
• create or take part in unlawful gambling, lottery or pyramid schemes;
• publish or distribute obscene or defamatory material;
• publish or distribute material that incites violence, hatred or discrimination;
• unlawfully collect information about others.

6. Privacy protection

By using our site, you may provide us with certain information. You authorize us to use your information in Canada and in any country where we may operate. When you register, you provide a valid email address and possibly additional information (name, billing information). We may receive information through various web technologies (cookies, history, invisible pixels, tags). You may disable cookies in your browser; we will still receive the information you provide us directly. 7. Reverse engineering and security

You may not (a) reverse engineer or disassemble any code or software on or from this site; nor (b) breach or attempt to breach the site's security through any unauthorized access, circumvention of encryption or any other security tool, data mining, or interference with any host, user or network.

8. Data loss

We are not responsible for the security of your user account or its content. Use of the site is at your own risk.

9. Indemnification

You agree to defend, indemnify and hold harmless OnFit Inc. and its affiliates against any claim, suit or demand, including attorneys' fees, arising from or relating to your use or misuse of the site, your violation of these terms, or your conduct. If we choose to do so, we will select our own counsel and participate in our own defense.

10. Anti-spam policy

You are strictly prohibited from using the site or any service offered for illegal spam-related activities, including the collection of others' addresses and personal information or the sending of mass commercial emails.

11. Third-party links and content

We may publish links to third-party sites or services. We are in no way responsible for damages or losses related to the use of third-party services linked on our site.

12. Severability

If any of these clauses is found to be illegal, declared null or unenforceable, in whole or in part, the unenforceable portion will not affect the validity and enforceability of the other clauses of these terms.

13. Service interruptions

We may have to interrupt your access to the site to carry out maintenance or unplanned emergency work. You agree that your access may be affected by unplanned or unanticipated unavailability, for any reason, and that we will in no case be liable for damages or losses arising from such unavailability.

14. Termination of the user account

We may suspend, limit or terminate your user account and your use of the site at our sole discretion, at any time, without notice and for any reason. We will have no liability to third parties for any suspension, limitation or termination of your access to the site.

15. No warranty

Although we have made reasonable efforts to ensure the accuracy of the content, we cannot guarantee that it is error-free, up to date or exhaustive. The site and its content are provided "as is" and "as available," without representation, warranty or condition of any kind, express or implied. We do not guarantee that the site will be available uninterrupted or error-free, or free of viruses. You agree to keep your passwords and identifiers confidential and to assume responsibility for activities related to their use, and to notify us of any unauthorized use.

16. Confidentiality

17. Limitation of liability

We are in no case responsible for damages you may suffer arising from your use of the site, to the fullest extent of the law. OnFit Inc.'s maximum liability arising from your use of the site is limited to one hundred (100) Canadian dollars or the amount paid to OnFit Inc. in the last six months, whichever is greater. This applies to any claim, including without limitation loss of profits or revenue, indirect or punitive damages, negligence, civil liability or fraud of any kind.
